Judgment for €1.6m sought over supply of used cooking oil to biodiesel firm

British group Phillips 66 says it has not been paid for oil supplied to Dublin-based Irish Biofuels Production Ltd

A UK fuel company is seeking judgment in the Commercial Court for £1.4 million (€1.68 million) against an Irish biodiesel firm which has allegedly not paid for more than 8,000 metric tonnes of used cooking oil supplied to it.

London-registered Phillips 66 Ltd said that in December 2023, through its subsidiary Phillips 66 TS Ltd, it agreed to sell 5,000 tonnes of used oil to Irish Biofuels Production Ltd, a manufacturer of biodiesel, production and supply of fuel with a registered address in Dundrum, Dublin.

It further agreed, in March 2024, to sell another 3,900 tonnes to Irish Biofuels.

In proceedings that were admitted on consent to the Commercial Court on Monday by Mr Justice Mark Sanfey, Phillips 66 said that despite certain payments by Irish Biofuels and undertakings to discharge regular payments, the defendant defaulted.

Legal proceedings were then issued and Phillips 66 now seeks judgment for £1.4 million or its euro equivalent.

Mr Justice Sanfey adjourned the hearing of the application for judgment to May.
