A BUILDING company has brought a legal action aimed at completing the sale for €2.4 million of office units in Santry.
Deerbay Properties Ltd, with registered offices at Lower Hatch Street, Dublin, has brought its case against National Mortgage Services Ltd, Seapoint Building, Clontarf Road, Dublin, over alleged contracts of June 2007 for construction and sale of three commercial office units at Northwood Court, Northwood, Santry, Dublin.
The proceedings were admitted to the list of the Commercial Court yesterday by Ms Justice Mary Finlay Geoghegan.
Deerbay claims that, under contracts of June 2007, it had agreed to build the units at Northwood and to sell them to NMS for a sum of €375,000 for the units and €2.075 million for the construction works.
It claims it was entitled at any time after November 1st, 2007, to call upon the defendant to complete the purchase.
However, despite the service of notices, the defendant had indicated it was only prepared to complete the sale of one unit and was seeking to postpone completion relating to the others, Deerpark claims.
Because of the defendant's alleged failures, Deerpark claims it continues to have to service a mortgage debt on the premises in the sum of about €500 daily.
