THE OWNERS of the Shelbourne Hotel will apply to the High Court next week for an order compelling the company managing the landmark Dublin city-centre hotel to allow them access to the hotels' books and records.

Yesterday, Mr Justice Roderick Murphy gave the owners, Shelbourne Hotel Holding Limited, permission to serve notice of its intention to seek the order against Toirram Hotel Operation Co Ltd, part of the Marriott Group, to grant them access to the business's books, records and staff.

The judge returned the matter to early next week.

The hotel, located at St Stephen's Green, is owned by a consortium of businessmen - John Sweeney, Bernard Doyle, Bernard McNamara, Gerry O'Reilly and David Courtney.

Counsel for the owners Brian O'Moore SC said the injunction was being sought in order to get financial information relating to issues concerning the operation of the hotel.

He said accountants working on the owners' behalf had requested that they be furnished with the hotel's books and records.

However, the defendants had not handed over the documentation, he said.

Counsel said the owners contended that, as part of a management agreement of August 2006 between the parties, the owners are entitled to look at the records requested.

The management agreement for the Shelbourne Hotel was also subject of a termination process but there was a request for arbitration in that matter, counsel added.
