A SON of hotelier Jim Mansfield has lost his application for a stay on summary judgment orders for €6.32 million against him and others over unpaid loans to buy and develop lands in Co Meath.
AIB, which sought the judgment orders, yesterday also secured interim charging orders over shares held by James Mansfield jnr and three other businessmen.
The affected shares are held in a range of different companies.
Last week, Mr Justice Peter Kelly ruled AIB was entitled to summary judgment orders for some €6.32 million against Mr Mansfield jnr, Palmerstown House, Johnstown, Co Kildare; Brian Higgins Allensgrove, Celbridge Road, Leixlip, Co Kildare; Glen O’Callaghan, Drapier Road, Dublin 11 and Séamus Kavanagh Kyle, Killea, Templemore, Co Tipperary.
He granted summary judgment after finding none of the four had made an arguable defence to the bank’s claim allowing the matter go to a full hearing. He placed a stay on the judgment orders for a week to allow consideration of an appeal.
Yesterday, the judge refused an application by counsel for Mr Mansfield jnr to extend the stay further. No extension of the stay was sought by the other defendants. He also granted an application by Denis McDonald SC, for AIB, for interim charging orders over various shareholdings of the defendants, and returned that matter to later this month.
The bank had sought the judgment orders arising from loans advanced to the four from 2003 in connection with the purchase of a site at Duleek, Co Meath.
