A company associated with the property group, Zoe Developments, is behind the planning appeal against the ESB's proposed power station at Ringsend, Co Dublin, The Irish Times has learned.

Last Friday a company called Fabrizia Developments appealed to An Bord Pleanala over Dublin Corporation's decision to grant planning permission for the £200 million (€253 million) project.

The directors of Fabrizia Developments, according to documents lodged with the Companies Office, are Mr Liam Carroll of Mount Merrion, Co Dublin, the managing director of Zoe Developments, his wife, Ms Roisin Carroll, and Mr David Torpey, a director of Zoe Developments and several other property companies.

The company has a registered address at La Touche House, Grove Road, Rathmines, Dublin, and according to Companies Office documents was incorporated in December as a general trading company.

In its appeal to An Bord Pleanala, Reid Associates (a town planning consultancy), on behalf of Fabrizia, said the company owned 12.2 acres of land near the proposed site for the plant on Pigeon House Road. It said Fabrizia Developments intended to develop these lands for mixed commercial and residential use.

It said if the power plant was built it would adversely affect the development potential of its site at South Bank Road. It added that building the power plant in the area might also worsen existing "poor" environmental conditions in the area.

Reid Associates said Fabrizia had "invested heavily" in the area and the ESB's planning application did not properly recognise the shifts in land usage in the docklands area. It claimed the power station would affect the implementation of the Dublin Docklands Development Authority's master plan for the area.

In addition, it contended the adequacy of the Environmental Impact Statement was "flawed" in several respects. "The plant size, shape, finish, layout is not defined and it is stated by the ESB that they cannot confirm same until a contractor has been appointed," the appeal claimed.

Reid Associates added concerns about the impact of noise from the plant in the area and queried the ESB's plans to treat the area for contaminants. The report from Reid Associates was written by Ms Ann Mulcrone but she was unavailable for comment. A spokesman for the ESB refused to comment, but it is understood the company will strongly reject the points raised by Fabrizia.
