In yesterday's editions, a report from Tralee Circuit Court of a successful appeal by Mr Martin Ferris of Casement's View, Ardfert, Co Kerry, against a three-month prison sentence said the sentence, imposed in the District Court, was for abusive language and provoking a breach of the peace. We have been asked to clarify that Judge Kevin O'Higgins, in Tralee Circuit Court ion Tuesday, held that while there had been prima-facie evidence of abusive language, the facts proved did not sustain a charge of insulting words or behaviour with intent to provoke a breach of the peace or recklessness as to whether a breach of the peace might have been occasioned.
