On the front page of our issue of the 23rd April, 2005 we carried a report of a hearing before Judge Bryan Smyth concerning a dispute involving allegations of nuisance between neighbours living in Beech Hill Drive, Donnybrook.
We reported wrongly that Judge Smyth ordered that the respondents to the complaint would go to jail if they turned on their television or played music between the hours of 10.00pm and 8.00am at any time during the next five years.
The actual Order made by Judge Smyth was conditional and would take effect only if the playing of music or switching on of a television or radio caused a nuisance to the respondents' neighbour.
We wish to sincerely apologise to Judge Smyth for any hurt or upset caused to him either personally or in his position as a Judge of the District Court. We are making a donation in an amount agreed with Judge Smyth to the Stephen Cluskey Spinal Injury Appeal Fund.
