A residents' group has initiated legal proceedings against the decision to locate a municipal waste incinerator in Poolbeg, in Dublin.

The Combined Residents Against Incineration group today lodged papers with the High Court initiating an appeal against Minister for the Environment, the Attorney General, Dublin City Council and An Bord Pleanála.

In its summons, the group claims Ireland has failed to transpose its obligations under EU Council directives into Irish law.

It contends the plaintiff is entitled to have access to a review procedure to challenge the legality of the decision by An Bord Pleanála to grant planning for the incinerator.

Permission for the 600,000-tonne incinerator was granted last November. The plant is due be located on a 13.5 acre site in Poolbeg, to the west of the regional sewage plant.

The main incinerator building, which will be 200 metres long, will be adjoined by two 100m chimney stacks.

The controversial development attracted more than 2,500 objections and was opposed by several politicians, including Minister for the Environment, John Gormley.
