A former worker in Leinster House who, it was admitted, was exposed to asbestos and should not have been, has settled his action for damages against the Office of Public Works.
In the High Court yesterday, Mr Pat O'Connell, for Mr Anthony Burke (66), of Pearse Street, Dublin, said the case was settled and could be struck out.
No details of the settlement were given to the court and Mr Justice Barr made the order sought.
Mr Burke had claimed he was exposed to asbestos over a 10year period while working as a general operative underground in Leinster House. He assisted plumbers and broke open parts of structures. The work included breaking asbestos lagging on pipes.
Opening the case on Tuesday, Mr John Sweetman SC, for Mr Burke, said his client was given minimal protection for his work, although the State was aware of the asbestos problem.
Mr Sweetman said Mr Burke had scarring on the lung from asbestos and, as a result, had considerable mental anguish and psychiatric problems.
