Mr Justice Moriarty has clarified the meaning of aspects of the terms of reference of the tribunal of inquiry into payments to Mr Charles Haughey and Mr Michael Lowry while they held public office.
The sole member and chairman of the tribunal said yesterday when it resumed that he wanted to clarify the notion of an association between Mr Haughey or Mr Lowry and a company, as mentioned in the terms of reference.
"The tribunal's view is that it connotes the widest range of potential connections, including an involvement with the company as a promoter, a shareholder, an officer, an adviser, an employee, an agent or any connection, but in every case involving a dealing or dealings which are significant whether by reason of their frequency, their substance or otherwise," he said.
On the words "did any act or made any decision", Mr Justice Moriarty said this would mean taking action or doing something or behaving in a particular way, which might include omitting to act in another or alternative way.
