A BANK seeking to recover €2.5 million from fugitive solicitor Michael Lynn was given permission by the High Court yesterday to serve notice of legal proceedings against him by placing advertisements in Hungarian and Portuguese newspapers.
KBC Bank Ireland plc, trading as KBC Homeloans, said it needs to be able to place the advertisements in places Mr Lynn is believed to be residing as his exact whereabouts are unknown.
Katie Mann, for KBC, said personal service on Mr Lynn of the legal documents was not possible.
Brian Baily, solicitor for KBC, said in a affidavit he had ascertained from various newspaper articles Mr Lynn regularly travels between Portugal and Hungary.
He believed Mr Lynn had no defence to the proceedings against him and no repayments had been made on the loan.
Mr Baily added he was not aware Mr Lynn had any close relative in Ireland on whom the proceedings could be served.
Mr Baily said a judgment order for €2.5 million against Mr Lynn had been entered last November and KBC was seeking an order that sum stood “well-charged” over five properties at Cluain Bui, Carrick-on-Shannon, Leitrim, which were used as security by Mr Lynn and another man for a loan of €755,000 made in 2003.
