A MAN, whose brother died following an attack at a city park, has been charged in relation to a public order offence on the same night.
Damien Organ (25) and his brother Liam (27), both of William St in Waterford city, were set upon with hurleys and other implements on March 21st at a secluded area of the People’s Park in the city.
Liam Organ suffered a fractured jaw and bruising to his upper body in the attack, at about 11.40pm.
His brother never regained consciousness and remained on life support at Waterford Regional Hospital before his death there on April 1st.
Kieran Deegan (19) and Martin O’Brien (20), who formerly lived together in an apartment on the Quay in the city, have been charged with the manslaughter of Damien Organ.
The pair were previously charged with the assault of Mr Organ, causing him harm, and later with the assault on Liam Organ.
Mr O’Brien appeared at the District Court in Waterford again yesterday in relation to the two charges.
Liam Organ also appeared in court yesterday charged with affray at the park on the same date contrary to section 16 of the Public Order Act 1986.
On Inspector Padraig Dunne’s request, Judge David Kennedy adjourned the matter to Tuesday next for service of the book of evidence.
Separately, Mr O’Brien appeared in court again yesterday charged in relation to assault causing harm of another man at an apartment in November 2009.
Garda Chris Murray told Judge Kennedy that when he was informed of the charges yesterday, Mr O’Brien replied: “I was drinking on the night; apologise for my actions.”
Inspector Dunne told Judge Kennedy that on November 18th last Mr O’Brien got into an “argument” with the man when he was asked to leave the apartment.
It is alleged that Mr O’Brien knocked the man to the ground and that he “struck him with a bottle”.
Judge Kennedy adjourned all of matters relating to Mr O’Brien to June 15th after an application by his solicitor Kenneth Cunningham, who said that “emotions are strained” between Mr Organ and Mr O’Brien.
