A building site which was closed down by the High Court in November on the application of the National Authority for Occupational Safety and Health, and which was then reopened before Christmas after undertakings had been given, was again closed by order of the court yesterday.

Mr Justice Kelly was told by a health and safety inspector yesterday that he believed Kilkishen Homes Ltd, which is building houses on a site at Monroe, near Nenagh, Co Tipperary, had once again displayed a "blatant disregard" for health and safety of employees there.

The inspector, Mr Dermot O'Brien, said he had no confidence in a reluctant agreement given by company representatives last week.

He said undertakings to the court had been breached already.

In the interests of health and safety, the prudent course of action was to seek relief from the court under the Safety and Welfare at Work Act, he said.

The judge directed that the site be closed until further court order and gave leave to the authority to apply today for the committal to prison of a director of the company, Mr Jason Madden, who had given an undertaking to the court on November 29th.
