Dun Laoghaire Rathdown County Council has agreed in the Supreme Court not to proceed with any road works at Carrickmines Castle in Co Dublin, until a judicial review is heard.

Yesterday the Supreme Court allowed a judicial review in the High Court against the construction of a roundabout on the Carrickmines Castle site.

The court unanimously found that a Co Kerry man, Mr Michael Mulcreevy, had established a "substantial" ground for a further legal challenge to the roundabout construction at the M50 extension.

The three-judge court granted his appeal after the High Court earlier this month refused him leave to take judicial review proceedings.

Today, Mr Colman Fitzgerlad SC for Mr Mulcreevy had sought an injunction stopping any road works at the monument. Chief Justice, Mr Justice Keane said he would not grant the injunction beacause it would go beyond the original appeal brought by Mr Mulcreevy.

However, Mr Justice Keane said the hearing of a judicial appeal was of the utmost urgence and should be heard in the next couple of days. He asked Mr Dermot Flanagan SC for Dun Laoghaire Rathdown County Council if they would take an undertaking not to perform any works at the monument. Mr Flanagan agreed.

Mr Justice Keane also discharged estimated costs of €100,000 awarded against Mr Mulcreevy when he failed to gain a judicial review in the High Court.

Costs in the case will now be decided by the High Court at the judicial review for which a date of hearing is to be decided.
