The High Court has granted orders to the Environmental Protection Agency (EPA) preventing a waste company accepting any further waste at a facility near Naas, Co Kildare and directing it to remove waste from specified areas of the site.
A solicitor for Neiphin Trading Ltd, John Sheedy, said the company was not opposing the orders, was not complacent and had not abandoned the site but the reality was, without funds, it could no longer process the waste.
Mr Justice Seán Ryan said it was a difficult situation as he had previously given injunctions in the matter and it was fairly clear the company was in financial difficulty.
However, the position was the company was still in existence and remained a lawful entity, he said.
