Lawyers representing a man who claims he was abused by a cleric while he was a child in care at Madonna House in Dublin have not yet been told if the State will pay the cost of rehearing the case in the High Court.
The case had been heard over several days by the former High Court judge Mr Cyril Kelly. Judgment was reserved and the judge resigned over the Sheedy case without delivering his judgment.
Last month the State said it would pay the costs of rehearing Supreme Court cases with which the former judge Mr Hugh O'Flaherty had been involved and in which judgment was not yet delivered. No reference was made to the costs of any High Court rehearings necessitated by Mr Kelly's resignation. The Dublin barman's action is against the Eastern Health Board and Madonna House, the nominee of the Religious Sisters of Charity Provinciate. As well as legal costs of around £200,000, there are also expenses for witnesses.
