A LEGAL action by Dublin City Council against a former garda over fire safety standards at three properties owned by him has been resolved.

A High Court judge had previously granted the council a number of injunctions directing Kevin Galvin, Furrypark Road, Killester, the landlord of two properties at Cabra Park and a unit to the rear of a Phibsboro Road property, to ensure those properties were vacated.

Three adults and an 18- month-old child were found living in a shed in the yard beside the main house at the Phibsboro Road property.

They were using an oven to heat the unit and the yard was covered in clutter, which also presented a fire hazard, the court had heard.

Mr Galvin, a former garda who worked in information technology at Garda Headquarters in Dublin, was sacked from his job over his property dealings.

His dismissal from the force was approved by Cabinet in recent weeks and has since come into effect.

The council had brought its proceedings against Mr Galvin under provisions of the 1981 Fire Safety Act because of what it claimed was the seriousness of the situation.

Yesterday, the president of the High Court, Mr Justice Nicholas Kearns agreed, following an application by James Connolly SC, for the council, to discharge the injunction in relation to one of the Cabra Park properties. Counsel said fire safety certificates had been obtained for that premises.

The court also heard Mr Galvin had undertaken to change the other properties at Cabra Park and Phibsboro Road from multi to single-dwelling units.

While this brought those properties outside the provisions of the Fire Safety Act under which the injunction orders in respect of those dwellings were made, Mr Connolly said it had been agreed the council could carry out inspections to see if two properties had been changed and could come back to court if the undertakings were breached.

The properties had been subject to fire safety notifications issued in April 2008, which had not been complied with, it was stated.
