A sculptor and poet has secured a High Court order quashing a decision of Dublin Corporation to erect the millennium "spike" in O'Connell Street.
Mr Justice Smyth quashed the corporation's decision to proceed with construction of the monument and granted Ms Mary Duniyva a declaration that the corporation had failed to comply with planning regulations in relation to the proposed development.
Ms Duniyva, of Windsor Road, Rathmines, had claimed the proposed monument was referred to in common parlance as "The Spike" and said it would be "an anorexic alien body, alien from every angle in material, size, shape and symbolism".
She also claimed that the proposed 400 ft monument would not bear any relation to existing buildings in terms of scale or quality.
Earlier this month, the same judge held, in proceedings taken by artist Mr Micheal O Nuallain (71), Belgrave Square, Monks town, Co Dublin, that because the corporation had failed to adhere to correct procedures in the planning process, the entire process for construction must start again.
The court had been told the corporation had already spent £600,000 on the project.
Mr Justice Smyth agreed with Mr O Nuallain's claim that an environmental impact statement was required for the monument because it was likely to have significant effects on the environment. No such statement had been carried out.
