A CENTRA store has used eight prefabricated Portakabins to extend its shop in Dalkey, Co Dublin, the Circuit Civil Court has been told.

Dún Laoghaire Rathdown County Council inspector Martin Cassidy told Judge Jacqueline Linnane that the development did not have planning permission.

Marie Ballyguile Ltd., which trades as Marie’s Centra Barnhill Stores, Barnhill Road, Dalkey, may be forced today to close down the unauthorised extension.

Yesterday’s was an ex parte (one-sided) application by the local authority. The shop owners will have an opportunity to enter a defence at the court this morning.

Yesterday barrister Carol O’Farrell was granted leave to serve short notice on the store of the local authority’s intention to restrain continuation of the unauthorised development and have it demolished.

Mr Cassidy told the court eight Portakabins had been placed side by side to form an open plan extension to the existing shop. There had been several complaints from neighbours.

He said there was no planning permission for the development although he had been informed that an application to retain the extension had been made to the council.

Mr Cassidy said an application for retention did not prevent the initiation of proceedings enforcing compliance with the planning laws. He told the court the open plan interior of the joined up Portakabins had been fully stocked.
