Dead man's brother sues ex prisoner

A FORMER loyalist paramilitary, Mr Brian Nelson, is facing a second compensation claim, it emerged yesterday.

A FORMER loyalist paramilitary, Mr Brian Nelson, is facing a second compensation claim, it emerged yesterday.

The 48 year old ex soldier from Belfast, who was released from prison earlier this month, is being sued by Mr Declan McDaid, a brother of a man he was once accused of murdering.

News of the latest action comes a week after it was revealed that Mr Nelson is also being sued by the widow of the murdered Belfast solicitor, Mr Pat Finucane.

Mr Nelson had been charged with murdering Mr McDaid's brother, Terence, in his north Belfast home in May 1988. But the charge was dropped before Mr Nelson's trial in 1992 when he was jailed for 10 years for conspiring to murder five Catholics.

It later emerged that Terence McDaid was shot in mistake for his brother, Declan, who is now claiming compensation for personal injuries and distress.

A writ issued in the High Court in Belfast claims that Mr McDaid's loss resulted from a breach of duty by Mr Nelson and his co defendants, the Ministry of Defence.
