A case for constructive dismissal taken by a former employee against the Bishop of Cloyne, Dr John Magee, was withdrawn at an Employment Appeals Tribunal hearing in Cork yesterday morning.

A spokesman for Dr Magee said yesterday that "the case has been settled on terms acceptable to both sides". He would not comment any further. The case was taken by Mr Damian Jones, who had worked in administration for the diocese for eight years until last April.

The chairwoman of the Cork division of the Employment Appeals Tribunal, Ms Kate O'Mahony, told the assembled media at yesterday's hearing that a letter which had been received from Mr Jones's solicitors, Patrick Buckley & Co, stated that the case was being withdrawn.

"This frequently occurs," she said, "Any further comment from the tribunal would be inappropriate."

Mr Jones, who is in his early 30s, and currently works in the registrar's office at University College, Cork, was not available for comment yesterday. He has been on sick leave from his post at the university since last Monday. His solicitor, Mr Patrick Buckley, was unavailable throughout the day yesterday, as he was "in consultation with a client".
