A hearing date regarding leniency of the sentence imposed on Anthony Lyons, the businessman convicted of sexual assault, has been applied for at the Court of Criminal Appeal by the Director of Public Prosecutions.

Lyons, of Griffith Avenue in Dublin, is due to be released from prison in mid-December after he was jailed for six months at the end of July for attacking and sexually assaulting a woman on Griffith Avenue more than two years ago.

Kerida Naidoo SC, prosecuting, applied to the court for a date within the next three weeks in the hope of having the case heard prior to Lyons's release.

He told Mr Justice Aidan Hardiman submissions have been drafted and approved and would be filed by Friday.

Mr Justice Hardiman said he would inquire whether a date could be found and put the case back for mention tomorrow morning.

Defence counsel Lorcan Steins requested transcripts from the eight-day trial which prosecuting counsel said it would be able to expedite.

Lyons, who owns an aircraft leasing company, originally denied attacking the woman when he was arrested near the scene on October 3rd, 2010.

However, 10 days later, the 52-year-old father of four went back to gardaí and claimed he attacked the woman because he was on cholesterol medication - a defence that was rejected by the jury after the trial.

Mr Justice Desmond Hogan sentenced Lyons to six years in prison but suspended five and a half years and ordered him to pay €75,000 to the victim.
