A High Court judge yesterday sent a Dublin man to jail for breaching undertakings given to the court regarding the operation of a hackney business from a builders' providers yard at the Naas Road, Dublin.
Mr Justice Kelly told Richard Cullen, of Tyrconnell Road, Inchicore, he could not give undertakings on oath, dishonour them and then tell "a cock-and-bull story" and expect the court to believe it.
He committed Cullen to prison overnight and would consider what further steps to take today. The judge also told Cullen's wife, Kathleen, he would consider today whether to send her to prison.
The judge made the order committing Cullen to prison on the application of Mr Paul Burns, for Dublin Corporation, and after hearing evidence from Cullen and his wife. In proceedings under the planning Acts, the corporation claimed Cullen and his wife had failed to honour undertakings given to the High Court on May 11th last that he would restrict the use of premises at Naas Road to a builders' providers and demolition yard and cease using it for a taxi-cab business.
