A former ESB worker decided yesterday not to pursue a High Court action against the company seeking damages for alleged work-related hearing loss. He has to pay the semi-State organisation's legal costs, estimated to be a five-figure sum.
Mr William Tilly (65), Bath Avenue Gardens, Sandymount, Dublin, was the second ESB worker to withdraw his claim for damages. Last week Mr Bernard Farrell (59), Ballinteer, Dublin, withdrew what was regarded as a test claim on the second day of the hearing.
In a statement, the ESB welcomed the decision and said it would be recovering full legal costs, adding that the company would be mounting vigorous defences to all such claims.
