A GALWAY man who sexually assaulted his daughter when she, was 17 has been jailed for two years by Mr Justice Morris.
The defendant, a 45-year-old separated father of two, pleaded guilty in January at the Central Criminal Court to sexually assaulting his daughter in Galway city on April 27th, 1994.
The court was told that the defendants wife had separated from him and had taken a local authority flat in the city with her daughter. Her son also lived there until he was 15 and then moved in with his father.
On the day of the incident the mother was in hospital and the daughter arrived home to find her father in the flat. He followed herb into her bedroom as she was going to bed.
Mr Maurice Gaffney SC, prosecuting, said the girl was apprehensive and went to bed still dressed in her jumper and jeans. Her father got into the bed wearing only a T-shirt and underpants. She asked him to get out but he did not.
He tried to talk to her about her mother but she did not want to. She went to sleep but awoke to discover her father kissing her. He had also removed her underwear and was sexually assaulting her, the court was told.
