The legal team representing Mr Joe Murphy jnr has not delivered the full set of documents which supports its contention that Mr Murphy was out of the country on June 8th, 1989 - the most likely date the alleged bribe was paid to Mr Ray Burke.
During cross-examination of Mr Gogarty, Mr Garrett Cooney SC delivered something of a bombshell when he announced that Mr Murphy had flown to Britain on June 5th, and not returned until he went to a funeral in Ireland on June 9th. Mr Gogarty had argued that Mr Murphy was in the room when a payment was made to Mr Burke.
Mr Cooney told Mr Justice Flood that there would be corroborating evidence to back up Mr Murphy's contention. However, the chairman has asked for a narrative from Mr Murphy and, before Easter, gave Mr Cooney time to supply it along with details of the corroborative evidence. Mr Cooney replied that Mr Murphy was out of the country, which was making things difficult. Mr Justice Flood, who has in the past indicated that he would take a signed fax from Mr Murphy, was told yesterday that Mr Murphy is now on holidays. The chairman said this was not good enough.
