A FORMER Co Clare doctor was yesterday returned for trial in relation to 44 separate charges of larceny, deception and getting money by false pretences arising from his treatment of cancer patients for cash payments.

At Tulla District Court yesterday, a book of evidence was served on Paschal Carmody (60), of Ballycuggaran, Killaloe. He was further remanded on bail to appear before the next sittings of Ennis Circuit Court.

Mr Carmody first appeared at Limerick District Court in December where 18 charges were brought against him. Those charges related to offences of larceny, deception and getting money by false pretences in respect of three injured parties on dates between January 2001 and December 2002.

At Killaloe District Court in January, an additional 26 charges were brought against Mr Carmody under the Larceny Act and the Criminal Justice Theft and Fraud Offences Act.

In relation to these charges, Mr Carmody is charged with receiving a total of €35,436 through falsely pretending to three cancer patients that they would be cured by photodynamic therapy at the East Clinic, Killaloe, between January and September 2002.

The court was told yesterday that the book of evidence in the case runs to two volumes.

Mr Carmody said only "yes" in court yesterday to confirm his signature to Judge Joseph Mangan.

As part of his bail conditions, Mr Carmody has already surrendered his passport, and is signing on twice weekly at Killaloe Garda station. He has also been required to provide a €1,000 surety.

The conditions also specify that he must not interfere with witnesses or alleged injured parties.
