A garda who claims he was defamed by a member of his local community has been granted discovery of documents currently in the possession of the Garda Siochana Complaints Board.

Garda Patrick Daly, of Riverstown, Killucan, Co Westmeath, is suing a garage-owner, Mr Brendan J McKeogh, of St Joseph's Terrace, Rathwire, Killucan, in relation to an alleged false and malicious communication to the Garda Commissioner.

His counsel, Mr Mark de Blacam, had sought discovery of the file of documents compiled by Supt Oliver Lewis during an investigation carried out by him following a complaint by Mr McKeogh.

Mr Paul O'Neill, counsel for the Garda Complaints Board, had opposed the application on the grounds that the documents were privileged and confidential.
