A former Garda superintendent who headed up one of the country's traffic divisions had a court case for drink driving adjourned yesterday.
Superintendent James Fitzgerald, who retired from the force after he was arrested on suspicion of drink driving last March, will now appear at Loughrea District Court on Wednesday, November 14th.
The 54-year-old had just been appointed head of the traffic section of the Western region when he was arrested near Loughrea on March 29th.
Mr Fitzgerald, Newgrove, Kilreekil, Co Galway, was not present in Loughrea District Court yesterday for the brief hearing.
The State Solicitor for east Galway, Tom McLoughlin, told Judge Elizabeth McGrath that the matter could be adjourned by consent.
Judge McGrath said that as she knew the accused she would have to excuse herself from hearing the case when it came to court.
The former Garda superintendent has been summonsed to answer two charges of dangerous driving at Cosmona, Loughrea, on March 29th.
The defendant is also charged with failing to supply a specimen of his breath at Loughrea Garda station on the same date.
The final charge alleges that he was under the influence of an intoxicant to such an extent as to be incapable of having control of a vehicle at Cosmona, Loughrea.
Mr McLoughlin told Loughrea District Court that it was his understanding that the case would not take up much of the court's time when heard.
The case is now due to be heard at Loughrea District Court on November 14th.
