The Garda Commissioner has served notice served on Det Garda Noel Mc Mahon, one of the men accused of lying in the Morris report into Garda activities in Co Donegal in the 1990s.

Det Garda McMahon who worked from Letterkenny Garda Station before his suspension from the force in the wake of allegations that he was part of a conspiracy that orchestrated hoax explosive finds.

The report authored by Mr Justice Frederick Morris's also found that he and Supt Kevin Lennon were among a number of gardai who furnished the tribunal investigating the claims with "a tissue of lies".

Senior gardaí who served in Donegal in 1993 and 1994 were accused of being negligent because they failed to uncover the plot.

Commissioner Noel Conroy instructed officers to serve served Det Garda McMahon with a copy of the tribunal report which sensationally called for the sacking or disciplining of up to 19 gardai including senior garda Supt Kevin Lennon.

Det Garda McMahon has been given time to reposed to the notice, the Garda Síochána said in a short statement late this evening.

Meanwhile, Chief Superintendent Denis Fitzpatrick, Garda National Traffic Bureau has announced his decision to retire from the force taking effect from September 1st 2004.
