The case of a midlands based garda who was found not guilty recently of sexually abusing a youth is to come back before Dublin Circuit Criminal Court in October due to his alleged conduct while on bail. Judge Kieran O'Connor listed the case for mention on October 10th next following an application by prosecution counsel Mr George Birmingham .

The 43-year-old garda was acquitted this month by a jury after a three-day trial of three charges of buggery of a male person, indecent assault and gross indecency on dates in 1987 and 1988.

The trial was originally scheduled for a date in June but was adjourned when the alleged victim did not appear. He was arrested on a bench warrant some weeks later and, when brought before the court, alleged the garda had offered him £10,000 not to give evidence in the trial.

A bench warrant was then issued for the garda who appeared voluntarily the next day. He denied making the inducement but was held in custody for some days. Because of that, he was given an early trial which ended in his acquittal on buggery and indecent assault charges.

Judge Joseph Mathews discharged him from custody after the jury of eight women and four men brought in a unanimous verdict of not guilty on each of the charges. He originally faced 12 charges, but the judge earlier directed the jury to find him not guilty of nine of these. The jury found him not guilty on one charge each of buggery, indecent assault and gross indecency.
