Michael Kinane's interim injunction case in the High Court was settled in his favour today.

The injunction was taken out to prevent the Turf Club imposing the two-day ban he was given for careless riding on Sophisticat at Leopardstown on July 18th after his appeal had been dismissed.

It was granted on the eve of the King George VI And Queen Elizabeth Diamond Stakes, allowing Kinane to take the winning ride on Galileo.

After the hearing, it emerged the agreed procedures had not been followed by the Appeals & Referrals Committee.

The committee announced that the appeal was dismissed and the suspension was confirmed instead of first allowing Kinane's legal team to make a plea of mitigation.

The decision of the Appeals & Referrals Committee to uphold the two-day suspension was declared null and void in the High Court.

There will now be a fresh reconvening of the Appeals & Referrals Committee with different Turf Club personnel. The hearing could take place early next week.

Kinane's solicitor, Andrew Coonan, said: "My client and I are both very pleased with the outcome."
