A group fighting the building of a roundabout on the M50 at Carrickmines Castle will learn tomorrow if they are to be granted a judicial review.
The Carrickminders group was in the High Court today seeking the review of the decision by the Minister for the Environment, Mr Cullen, to extend the M50 over the castle site.
The protesters argued that the Minister had no right to permit the destruction of the remains because he is both guardian of the remains and proponent of the motorway.
They are also arguing the Minister is overstepping his powers under the National Monuments Act by saying if he had the right to permit the works, it was only having determined that the ruins represent a threat to health and safety - which the group says is not the case.
However, counsel for the Minister argued that the court "couldn't presume the minister acted wrongly" and that it was "entirely coincidental that the Minister for the Environment has an interest in road building."
Counsel also stated it was up to the protesters to "show some reasonable rospect of success" before continuing with the hearing.
Mr Justice Paul Gilligan will deliver a ruling at 9 a.m. tomorrow.
