Methods of investigation

• Garda investigation: The Garda Ombudsman may refer a complaint to the Garda Commissioner for investigation under the Garda's disciplinary regulations. If you are not happy with the outcome of a Garda investigation, you can request that the Garda Ombudsman review your case.

• Supervised Garda investigation: The Garda Ombudsman can supervise an investigation carried out by the Garda. The Garda will report on the progress of the investigation in accordance with agreed guidelines. The Garda Ombudsman can direct gardaí in their investigation of the complaint. If it sees fit, the Garda Ombudsman can take over the investigation.

• Garda Síochána Ombudsman investigation: The Garda Ombudsman can mount investigations in cases involving death of or serious harm to a person as a result of Garda operations or while in Garda custody or care.

Possible outcomes

1. The Garda Ombudsman may make recommendations to the Garda Commissioner regarding disciplinary proceedings.

2. If it appears a case may warrant criminal prosecution, the Garda Ombudsman may send a file to the DPP.

3. If there is insufficient evidence to support one of the above, the case may be dismissed.
