The High Court has ruled the Health and Safety Authority is not entitled to investigate a road traffic incident in Co Donegal after which a woman aged 22 died.
The president of the High Court, Mr Justice Nicholas Kearns, yesterday granted Donegal County Council an order preventing the HSA from holding an investigation or prosecuting the local authority or its staff in respect of a single-vehicle incident which claimed Sinead McDaid’s life. The judge was satisfied the place where the incident occurred was “not a place of work”.
