€42,000 award for fall on footpath
A man who suffered a wrist and hand injury after he fell while has been awarded €42,000 in damages against NTL at the High Court.
Mr Justice Éamon de Valera yesterday found NTL was 70 per cent responsible and Martin MacCluskey, Botanic Road, Glasnevin, Dublin, 30 per cent responsible for the fall in July 1998 at Botanic Road.
The judge said that while the pavement was defective as a result of works carried out by NTL, it was still bright when Mr McCluskey had fallen and therefore he could not have been keeping a sufficient lookout.
He awarded €60,000 damages reduced to €42,000 on the basis of 30 per cent contributory negligence.
Irish Rail sued over train injury
A retired Iarnród Éireann employee whose left leg was amputated below the knee after he was hit by a train has sued the company for damages in the High Court.
Nicholas Dillon (67), Clondalkin, Dublin, alleges negligence and breach of contract against the company as a result of an incident at Heuston Station in June 2001, when he was struck by the last carriage of a train as he walked across a track.
Iarnród Éireann denies the claims and has also pleaded negligence by Mr Dillon.The case before Mr Justice Vivian Lavan continues on Tuesday.
Arms sentences adjourned
Two Clondalkin men have had their sentences adjourned for possession of a shotgun and ammunition over two years ago.
Desmond Kenna (23), Harelawn Avenue, and David Canning (36), Harelawn Green, pleaded guilty at Dublin Circuit Criminal Court to their possession at Cappagh Road, Finglas, in July 2004.
Two student inquests adjourned
An inquest into the death of Lily Hastings-Bass (20), the Trinity College Dublin student who was killed in a hit-and-run in December , has been adjourned as Garda inquiries into her death are ongoing.
Dublin City Coroner's Court heard yesterday that the British student had been in Ireland just two months when the incident occurred on Rathgar Road in Dublin, just yards from her home.
Also yesterday, an inquest into the death of student Rebekah Kiely (15) who died after being struck with a baseball bat during an assault in Castleknock, Dublin, was adjourned for two months.
Insp Brian Sherry of Blanchardstown station told Dublin City Coroner's Court that "the Garda inquiry is not yet completed".
