Agreement reached in property case

A case brought by a partnership involving broadcaster Gay Byrne, which related to an alleged agreement with a property advice company concerning the proposed development of a site at Tallaght, in Dublin has been dismissed on consent at the High Court.

The five-member Wood Partnership, of which Mr Byrne is a member, together with the five-member White Partnership, had sued Spain Courtney Doyle Commercial Ltd (SCD) and its directors, David G Courtney and Bernard T Doyle.

On the third day of the case yesterday, Paul Gallagher SC, for the partnerships, told the court agreement had been reached between the sides. The partnerships had also agreed to pay the costs of the defendants, he said.

Teenager caught with spear gun

A teenager who was caught with a spear gun, which fires a one-metre long metal dart, has been remanded on bail pending sentence.

The 17-year-old youth, who cannot be identified, had pleaded guilty at the Children's Court to possessing the spear gun on October 14th last.

Judge Catherine Murphy described the weapon as "lethal" and "on a par with a loaded gun".

Man released in trespassing case

A man was freed from prison on the direction of the High Court yesterday after agreeing to comply with court orders restraining interference with contractors working on lands which had been sold by his mother to Fingal County Council.

Last Tuesday, Fingal County Council secured an order for the jailing of Dermot Horan, Summerville, Navan Road, Parslickstown, Mulhuddart, Dublin, arising from his refusal to obey a court order preventing him from trespassing or obstructing contractors at lands at Macetown, north, Mulhuddart, Co Dublin.

Ms Justice Mary Laffoy directed yesterday that Mr Horan be released from jail after he purged his contempt, apologised to the court and gave a sworn undertaking not to breach the terms of the order.

Woman was sent explicit messages

A serial phone-call abuser, who harassed a single mother by sending her sexually explicit phone and text messages, has had his sentence adjourned again by Judge Katherine Delahunt at Dublin Circuit Criminal Court.

John Creighton (23), Cordaragh Drive, Kiltimagh, Co Mayo, formerly Ellensburg Avenue, Tallaght, pleaded guilty to harassment of Noleen Lawlor between September 1st, 2003, and February 26th, 2004. Judge Delahunt adjourned finalising sentencing to allow for an updated probation report.

Man cleared of punching woman

A brother of a man shot at point-blank range was cleared yesterday of punching a relative of the murderer.

Thomas McConnell (21), whose brother Ian (28) was shot in the back of the head in December 2005, denied assaulting Kim Kelly at Ballymun Road last November 8th.

Ms Kelly is a relative of Stephen Kelly (22), who, after he was jailed for life in February for the murder, boasted: "I'll take that on my back."
