Judgment reserved in garda case

A legal challenge by a garda to stop a disciplinary inquiry into alleged misconduct arising from claims that he physically assaulted two boys six years ago concluded at the High Court yesterday. Judgment was reserved.

Garda Brendan Ruigrok, Skerries, Co Dublin, is also seeking a declaration that the Garda Commissioner's failure to investigate the complaint speedily breached his entitlement to fair procedures.

Garda Ruigrok said a man had brought a complaint on November 28th, 2000. The garda said he and the complainant had sons who attended swimming classes at Gormanston College and the complainant had alleged Garda Ruigrok had physically assaulted two of his sons on November 29th, 1999. The garda denied any allegation of wrongdoing and said it was his own son who was the victim of bullying.

Doctor guilty of misconduct

The wife of a Co Clare GP who was struck off the medical register last year has been found guilty of professional misconduct by the Medical Council's fitness-to-practise committee.

Dr Freda Marian Keane Carmody was found guilty of professional misconduct following an inquiry in June. Details have only emerged because a decision by the Medical Council to attach conditions to the retention of her name on the medical register had to be confirmed by the High Court.

Dr Keane Carmody will have two conditions attached to her registration. These are that she makes copies of all patient notes and records available to the council when requested.
