Parents settle case over son's death

A Co Donegal couple whose infant son died 27 days after his birth at Letterkenny General Hospital have settled their High Court action for €75,000. The settlement is without admission of liability.

Wesley Knox and his wife Lorna, of Carrickshandrum, Killygordon, Co Donegal, had sued the North Western Health Board over circumstances arising from of the birth of their son Adam, who was delivered at the hospital on the June 21st, 1998.

It was claimed that prior to his birth, Adam's heart rate slowed causing brain injuries.

Garda seeks to stop inquiry

A garda has asked the High Court to stop the reactivation of an internal inquiry into his conduct after the DPP dropped a prosecution against him for allegedly accessing child pornography on a computer in Garda Headquarters.

Garda Darach Kennedy (43), of Dunshaughlin Garda station, claims a 31-month delay in the inquiry breached his rights to fair procedures.

His judicial review proceedings against the Garda Commissioner finished yesterday before Mr Justice John MacMenamin who reserved judgment.

Rape trial jury sent to hotel

The jury in the trial of a Cork man accused of raping his two sisters has been sent to a hotel overnight.

Mr Justice Paul Butler sent the jury away after it failed to reach a verdict at the Central Criminal Court. The man (50) pleaded not guilty to five charges of raping and sexually assaulting his eldest sister on dates between 1971 and 1976 in Cork.

He also denied eight charges of raping and sexually assaulting her sister between 1971 and 1979.

Man denies stabbing

A man has gone on trial in the Circuit Criminal Court in Tralee, accused of stabbing. David Doody (45), An Caisleán Mór, Castleisland, Co Kerry, yesterday denied the charge of assault causing serious harm to his brother John Doody (38) at Desmond's Avenue Castleisland, on January 8th, 2006. He also pleaded not guilty to a second charge of producing a knife in the course of a dispute.

Prosecuting counsel told the court John Doody had met his brother in the Half Barell Pub in Castleisland. Afterwards they walked to Desmond's Avenue, but near the entrance to the estate the accused produced a knife. John Doody was found on the green area of the estate with a knife wound. He had been stabbed through to the back wall of the stomach and his intestine had been  damaged.

Murder trial to resume

The Central Criminal Court jury in the trial of a Limerick student accused of fatally stabbing a man has been sent to a hotel for the night after deliberating for more than four hours. Joseph "Jody" Buston (21), Towerfield, Croom, Co Limerick, has pleaded not guilty to murdering Liam O'Donovan (59) at St Senan's Terrace in the village on November 4th, 2006.

Mr Justice Paul Carney told the jury it had a choice between a verdict of murder and manslaughter since Mr Buston had admitted to stabbing Mr O'Donovan.The jury resumes deliberations in the morning.
