Court halts prosecution of two doctors
The High Court has halted the prosecution of two doctors on charges arising from the deaths of two Brazilian men in a Co Galway house owned by the medical practitioners.
Drs Ralph and Elaine Keane, Rich Hill House, Lisnagry, Limerick, had brought judicial review proceedings aimed at overturning the DPP's decision to prosecute them for alleged reckless endangerment by failing to service a boiler in the house.
Roberto Perna Ramos and Erly Rodrigues Da Silva were found dead in the boiler house/utility room of the house at Áras Mhuire, Clonahaha, Ennis Road, Gort, Co Galway, on December 1st, 2005. Mr Justice Michael Hanna found the DPP had breached the Keanes's constitutional right to fair procedures in how the matter was handled and he made an order restraining the DPP from proceeding with a prosecution.
Woman gets damages over bikini wax
A young woman who said she had to take a fortnight off work because she was so sore following a bikini wax has been awarded damages by a judge.
Denise Moran, of Árd Collum Avenue, Artane, Dublin, told Judge Anthony Hunt in the Circuit Civil Court that she had been left very red, hot and tender following a "Hollywood" wax at the Therapie Body Clinic in Molesworth Street, Dublin, on May 27th, 2006.
The judge awarded Ms Moran general damages for pain and suffering of €7,500, with €1,000 for loss of earnings and €700 for special expenses.
Man jailed for threat to kill
A Meath man has been jailed for six years for threatening to kill someone who "owed money" for drugs.
Ciarán Dixon (25) was acting on behalf of dealers to try to recover a €15,000 "debt" run up by Colm Kelly, whom Dixon had introduced to the criminals.
Det Garda Patrick Traynor said Mr Kelly's mother, Linda Killock, raised €17,000 to pay off her son's debt after her car was burned out.
Dixon, of Beech Grove, Johnstown, Navan, told his defence counsel he had missed his October 31st, 2007, trial date because he had to leave the jurisdiction for his own safety after "drugs barons" kidnapped his brother Mark Dixon in connection with the debt.
Dixon said the dealers were holding him responsible for the debt as he had introduced Mr Kelly to them.
He pleaded guilty at Dublin Circuit Criminal Court to issuing threats to the Kellys and Ms Killock and also admitted possession of two shotgun cartridges.
Date fixed for Gilligan appeal
The Supreme Court will hear later this year an appeal by convicted drug dealer John Gilligan and other members of his family aimed at preventing several properties owned by them, including the Jessbrook Equestrian Centre in Co Meath, being handed over to the State after a High Court finding that they are the proceeds of crime.
The Supreme Court fixed October 15th as the date for the appeal. If the Supreme Court rejects the appeal, the State will be entitled to sell the properties.
Man convicted of sex assault
A man has been convicted of sexually assaulting a Galway woman last year.
Tomasz Wojtaniec (46), from Poland, with an address at the Mayfly Inn, Oughterard, Co Galway, was remanded in custody by Mr Justice John Edwards for sentence later at the Central Criminal Court.
The jury deliberated for some 11 hours before finding Wojtaniec guilty of sexually assaulting the woman as she walked home from a pub in a Galway town on May 9th, 2007, but not guilty of assault causing her harm on the same occasion.
Boy (13) set girl's hair on fire
A 13-year-old schoolboy who set a girl's hair on fire as they were travelling on a bus has been given six months to pay to get her hair restyled.
The boy pleaded guilty at the Children's Court to assault causing harm to the 17-year-old girl while travelling on Dublin Bus in north Dublin on October 17th, 2007.The court heard he "was sitting behind the girl and lit her hair . . . with a match".
The girl's hair was set alight briefly but she did not suffer any skin burns.
