Man tells court gardaí broke his arm
A Dublin man has claimed in the High Court that his arm was broken and he was struck on the the head when he was stopped and detained by armed members of the Garda Emergency Response Unit.
He said he was returning from Northern Ireland where he had purchased a quantity of fireworks.
Joseph Maher (31), Landen Road, Ballyfermot, Dublin, is taking an action for damages against the Minister for Justice and the State arising from an incident on the M50 on October 7th, 2002.
The defendants deny the claims and say that after a controlled stop, Mr Maher got out of his vehicle and tried to leave the scene; that he was intercepted and sustained a minor cut to his head in the course of resisting lawful arrest by a garda who used no more force than was reasonable in the circumstances.
The case continues today.
Contractors plead guilty over death
Two contractors have pleaded guilty in relation to a workplace incident in which a man was killed in Kenmare, Co Kerry, and another was injured.
Michael Burns (57) a father of three, Tahilla, Sneem, died and a Polish co-worker, Tomasz Ciolek, was injured while working in a trench on a housing development at Dromneavane, Kenmare, in October 2005.
Five charges under the Safety, Health and Welfare at Work Act 2005 were laid against Tinal Electrical Ltd, the Atlantic Bar, the Square, Kenmare, Co Kerry, and seven charges against a sole trader, Tony O'Sullivan, Killaha West, Kenmare.
The court has heard that the State intends to enter a nolle prosequi in the case of two other individuals summonsed in relation to the accident. Judge Carroll Moran adjourned the case to next week.
Sex offender on more charges
Robert Quigley, who was given a 12-year prison sentence last month for the false imprisonment and sexual assault of a woman in the Dublin mountains in November 2006, yesterday pleaded guilty to six offences including false imprisonment and common assault of a different woman and of making "unwarranted demands" of money with menaces" in Co Kerry, also in 2006.
Quigley, Seskin View Road, Tallaght, Dublin, was brought from custody into the dock. When arraigned he answered "guilty" to each charge including assaulting a woman at Dooneen Woods, Dooneen, Castleisland, Co Kerry, on August 20th, 2006, and to falsely imprisoning her.
Prosecution winds up in murder trial
The prosecution case against four men accused of the murder of a Limerick bouncer has concluded at the Central Criminal Court sitting at Cloverhill.
Gary Campion (24), Pineview Gardens, Moyross, Limerick; John Dundon (27), and Desmond Dundon (23), both from Ballinacurra Weston, Co Limerick, and Anthony Kelly (50), Kilrush, Co Clare, all plead not guilty to murdering Mr Fitzgerald on November 29th, 2002, at Brookhaven Walk, Mill Road, Corbally, Limerick.
Over 12 days of evidence the jury of 12 men has heard the State's case, mainly through the evidence of James Martin Cahill, currently serving a life sentence for shooting Mr Fitzgerald.
The trial continues in legal argument before Mr Justice Peter Charleton.
