Yesterday at Limerick District Court, Victoria Moverley (32), of no fixed abode but formerly with an address at Mount George, Borrisoleigh, Co Tipperary, was charged with assaulting Mr Tuleiko causing him harm on dates between April 13th and April 15th last.

Det Garda James White from Thurles Garda station told the court that he was seeking to have the accused remanded in custody as other serious charges were being contemplated and the injured party in the case was now deceased.

Solicitor Anna Fitzpatrick told the court that her client was a single mother who had three children in foster care.

She said Ms Moverley was a "chronic alcoholic" who had left the jurisdiction after the "serious incident" but had returned voluntarily and made herself available to gardaí for questioning in the past two weeks.

Judge Elizabeth McGrath refused bail and remanded Ms Moverley in custody until December 5th and ordered that the accused woman receive all relevant medical attention while in custody.

Legal argument in rape case

The trial of an Offaly farmer for the alleged rape of a teenage schoolgirl has continued at the Central Criminal Court with legal argument in the absence of the jury.

The 56-year-old man is pleading not guilty to raping and sexually assaulting the then 16-year-old girl on April 8th, 2004, in his 4x4 vehicle in a field.

It is day-four of his trial.

The hearing continues before Mr Justice Peter Charleton and a jury of four women and eight men.

Dwayne Foster file with DPP

Gardaí have taken statements from more than 150 witnesses in relation to the death of Dwayne Foster who died in Garda custody in March 2006, an inquest has heard, writes Georgina O'Halloran.

Supt John McAndrew of the National Bureau of Criminal Investigation told the Dublin city coroner that the large file into Mr Foster's death is currently with the DPP.

He sought a further adjournment of the inquest until March 2008 as he said a decision by the DPP was not imminent.

Mr Foster (24) was one of the main suspects in the shooting of young mother of one, Donna Cleary, who was shot dead at a party in Coolock in the early hours of March 5th, 2006, by a gunman who had earlier been refused entry to the celebration.

Solicitor for the family, Michael Finucane, requested the coroner to hold a further mention of the inquest into Mr Foster's death in January rather than March in the interest of expediting matters.
