A farmer who was stated to have failed to carry out anti-pollution measures is to be committed to prison by order of the High Court.
Mr Justice Lavan issued the order of committal against Mr Michael McCarthy, Skehaerin, Listowel, Co Kerry, on the application of Kerry County Council. Mr McCarthy was not present in court yesterday and was not legally represented.
The court was told Mr McCarthy last year agreed to an order to carry out certain works within three months. Mr Diarmuid Reilly, an assistant engineer with Kerry County Council, said he had visited Mr McCarthy's farm last Wednesday. He said the order had not been complied with and slurry was entering a drain which fed into the Feale River.
