The High Court judge who is hearing an action against a Dublin school, taken by a schoolgirl who claims she was bullied by fellow pupils, has said he will go to see the school yard where the alleged bullying incidents are said o have happened.
Evidence in the action by Nicola Mulvey, now aged 10, and suing by her mother, Ms Margaret Mulvey, Ashwood Avenue, Clondalkin, against Scoil Nano Nagle, Bawnogue, Clondalkin, concluded yesterday.
Afterwards, Mr Justice Johnson asked for lawyers in the sides to present written submissions and he adjourned the case until the new year.
Judgment is not expected for some time.
It is claimed that Nicola was bullied by fellow pupils on a number of occasions during the school year 1996/1997 when she was in senior infants class.
The school denies the claim and pleads that it, its servants or agents were not guilty of the alleged or any negligence or breach of duty.
Yesterday, Ms Caoimhe Warren, a teacher, said she was a supervisor in the school yard for about four months in 1997-98.
Nothing untoward occurred concerning Nicola, she said. There was also another teacher in the yard.
