An order preventing protests being held within 10 yards of the door of the premises of the Church of Scientology Mission of Dublin Ltd in Middle Abbey Street, Dublin, has been lifted by the High Court.
The temporary order had been granted in June against Mr Damien Fortune and Mr Dermot Fortune, Main Street, Gorey, Co Wexford, their servants or agents and any person having notice of the order.
Yesterday, Mr Justice O'Sullivan vacated the order after hearing evidence from counsel for the Fortune family that Mr Damien Fortune, who was named in the order, was in London at the time of the protest outside the premises on Monday, June 9th.
Mr James Macken SC, for the Church of Scientology, said his client acknowledged a bona fide mistake had been made in identifying Mr Damien Fortune as one of the family members present at the protest and wished to apologise to the court.
The temporary injunction was granted by the judge on June 10th on the application of Mr Kieran Ryan on behalf of the Church of Scientology Mission of Dublin, which yesterday came to court seeking an interlocutory injunction until the hearing of the action.
At a previous court hearing, Mr Ryan said the application concerned a controversy that had arisen in respect of a member of the Danish organisation of the Church of Scientology, based in Copenhagen.
The controversy had arisen in respect of Mr Odhran Fortune (24), a brother of the defendants.
Mr Justice O'Sullivan said evidence submitted in the initial application was unreliable in relation to the specific presence of people and their behaviour outside the premises.
Mr Diarmaid McGuinness SC, for the Fortune family, said that the court order had prevented members of the Fortune family from contacting Odhran Fortune.
