A judge has refused to strike out a case taken by the Eastern Health Board against the GAA for alleged breaches of food hygiene regulations after a barrister claimed the board was still building its case.

The GAA has been summoned to the Dublin District Court for 13 alleged breaches of food hygiene regulations at the main cafeteria in Croke Park's Hogan Stand during the Leinster Football Final last July.

In court yesterday, counsel for the GAA opposed an Eastern Health Board application for a two week adjournment saying: "They seem to be adjourning from time to time until they have a case against us."

However, the EHB argued it was still serving a witness summons against the cafeteria's operator, Mr Michael Lawlor, who received a record £55,000 fine this month for similar breaches.

Judge Gerard Haughton said the courts were too busy to fix a date within a week and adjourned the case for full hearing on March 5th.
