A 50-year-old special needs assistant yesterday lost a damages claim for a fall at her workplace and was ordered to pay her employer’s legal costs.

Philomena Allen, of Castleknock Elms, Dublin, said in the Circuit Civil Court that on February 5th, 2009, she had fallen on a wet floor while entering an outside classroom at Cabinteely Community School.

Judge Jacqueline Linnane said Ms Allen had failed to prove negligence against the school.
