The jury in the trial of a disco bouncer charged with assaulting a computer programmer who had emergency surgery to save his life has been discharged after failing to reach a verdict.
Mr Paul Burke (45) of St Finian's Grove, Lucan, had pleaded not guilty to assaulting Mr Kevin Daunt, from Longlands, Swords, on June 18th, 2001.
The jury at Dublin Circuit Criminal Court spent three hours deliberating on the fourth day of the trial before telling Judge John O'Hagan it was deadlocked.
Mr Daunt spent 26 days in hospital and was on a life-support machine.
He had emergency surgery to remove a clot from his brain following the incident.
Mr Burke denied in evidence that he used too much force to eject Mr Daunt from Judge Roy Beans.
Judge O'Hagan thanked the jury for its attention to the case.
He remanded Mr Burke on continuing bail.
A new trial will begin on a date yet to be determined.
