As things stand tonight Dublin West TD Liam Lawlor looks unlikely to make a statement on whether he is to appeal yesterday's High Court judgment against him.
However Mr Lawlor has still time tomorrow morning to appeal the judgment before his seven day prison sentence in Mountjoy is due to commence in the afternoon.
At 5 p.m. this evening the Supreme Court confirmed that Mr Lawlor had not yet registered his intention to appeal.
As a result, if he decides to do so, it will be at the earliest 10.30 a.m tomorrow. Tonight, Mr Lawlor said that his legal team is still waiting for a full transcript of the judgment. According to reports on RTE News, it is possible that neither Mr John Rogers SC nor Mr Pat MacEntee SC, defence counsel for Mr Lawlor will receive a copy of the ruling until tomorrow morning.
In yesterday's ruling, Mr Justice Smyth ordered the first seven days of Mr Lawlor's sentence for contempt be physically served from 2 p.m. tomorrow.
The balance would be suspended to enable Mr Lawlor to comply with the original orders by providing the Flood tribunal with all the documents it required.
Mr Lawlor will be arrested unless he arranges to present himself to the Garda once the legal papers are prepared tomorrow afternoon. Mr Justice Smyth also imposed a fine of £10,000.
