A witness today told the trial of a man accused of killing a father of two and assaulting another man during a disturbance outside a house in north Dublin told gardaí he heard someone being hit with baseball bats on the night of the incident.

Peter Dolan (42) of Tulip Court, Darndale denies the murder of Raymond Brown at Clonshaugh Drive in Coolock on April 2nd 2005. He also denies assaulting Emmett Taaffe on the same occasion.

A witness Mark Hempenstall told the Central Criminal Court today he had got out of a taxi near Clonshaugh Drive in Coolock on the night of the incident and saw a large group of people.

He said he could not remember anything that had happened that night but could remember a man running past him waving a crutch shouting "He's dead, he's dead."

He turned and saw a man lying in the middle of the road so he rang the emergency services.

He said he had not seen any signs of injury.

"When someone runs by saying he's dead, he's dead and someone's lying face down on the ground you put two and two together."
